Terms and Conditions
General Conditions of Sale
Scope of Application
The commercial relations between BARBOT – INDÚSTRIA DE TINTAS, S.A. (BARBOT) and any entity that acquires its goods and/or services (CLIENT) are regulated by these General Conditions of Sale. These General Conditions of Sale are always an integral part of any agreement from which the acceptance of an order by BARBOT arises.
The CLIENT hereby acknowledges these General Conditions of Sale, considering, in any case, that they have been understood and accepted in full and without reservation by the CLIENT.
These General Conditions of Sale revoke any others previously established, and BARBOT reserves the right to change these General Conditions of Sale without prior notice, which will always appear on its website updated in https://barbot.pt/sobre/ General Conditions of Sale tab.
Goods
BARBOT guarantees the conformity of its products in accordance with the technical specifications contained in the respective technical data sheets, so their application must be carried out in compliance with what is described therein.
In addition, and under the terms of Directives 2010/75/EU and 2004/42/EC, express mention is made of the fact that products identified with the marking:
These can only be used, without restrictions, in activities carried out in registered and authorized installations for this purpose, and their use in small installations is limited to coatings that do not concern any components for buildings, under the terms of the Law.
Thus, BARBOT is not responsible for a deficient or illegal use of its products, and the CLIENT is entirely responsible for the consequences of any improper use.
The CLIENT understands and acknowledges that the images of BARBOT’s products presented by them in the most diverse ways, namely in their catalogues, are merely illustrative, so that, in relation to the actual products, there may be variations in colour, content and/or packaging design resulting from their sample and display via online. In this way, for an exact match, the CUSTOMER can go to a BARBOT physical store in order to consult the products.
BARBOT reserves the right, at any time, to withdraw any product from the market, without prior notice and without any rights whatsoever to the CLIENT.
Prices
Supplies will be invoiced according to the prices contained in the Price List in force at the date of invoicing. VAT is levied on these prices at the rate in force. Prices are adjustable at any time without dependence on any prior notice by BARBOT.
BARBOT may, at a given time/business, without any type of obligation or liability, grant Special Offers, Promotional Discounts or other justified discounts, under legal and/or contractual conditions.
Payment Terms
Unless otherwise agreed in writing with BARBOT, the rule is that of immediate payment upon physical availability of the ordered products.
The payment methods are: direct debit, cheque, bank transfer, ATM or cash, under the terms of the law.
The CLIENT who has entered into an Annual Commercial Agreement with BARBOT and whose agreement is in force at the time, may ask BARBOT to open a current account for credit supplies. In case of approval (exclusive and discretionary decision of BARBOT), in this annual agreement the terms and limits of credit will be defined, as well as the payment terms to be practiced, which may change according to the average monthly volume of purchases and forms of payment.
Failure to pay within the established period, payment made by cheque without provision or the full use of the credit granted, will result in the immediate, temporary or definitive suspension of the execution and delivery of orders or parts of open orders, as well as the immediate maturity of all other outstanding credits in the name of the CLIENT, without prejudice to the right to debit interest at the applicable legal rate, to obtain the competent judicial collection and other rights that may be entitled.
If facts and/or circumstances occur that lead to a justified fear by BARBOT regarding the quality of the CLIENT’s creditworthiness and credibility, as well as its failure to comply with obligations on time, BARBOT reserves the right to suspend sales and respective deliveries of products on credit, as well as to demand advance payments or adequate guarantees of payments receivable.
The occasional acceptance of a delay in one or more payments does not imply a change in these General Conditions of Sale, nor in the credit and payment conditions assigned to the CUSTOMER.
Any change to the established conditions will only be effective if it is contained in a written document signed by both parties.
Orders and Deliveries
Orders may be placed by the CLIENT through email, EDI system and telephone, provided that they are later confirmed in writing. Whenever possible, the order should be made through a numbered document with the CLIENT’s header.
Orders will only be valid once they have been formally accepted, and BARBOT reserves the right not to supply, whether for reasons of commercial, financial or logistical conditions, any order that has not been accepted.
The products are supplied in the minimum sales quantities, or in multiples, as indicated in the Price List in force. Orders that do not match the minimum sales quantities, or multiples, will be rounded up to the nearest multiple.
BARBOT operates under the “pending” regime. In the event that an order is not fully satisfied, the missing part does not need a new order and is automatically sent as soon as it is available. The CLIENT may request, in writing, the opposite procedure.
In the case of orders with the same delivery date, an administrative fee will be charged for orders whose sum of the lines is less than €200.00, and BARBOT reserves the right to refuse delivery of part or all of the order. To the orders of mortars, transport costs are added according to the table posted at the beginning of each year. In situations of special or urgent transport, an additional fee may be charged for transport.
Delivery times depend on the type of products, stock availability and responsiveness in terms of transport.
The unloading of the products is carried out by the CUSTOMER and the driver must prepare the vehicle in advance. Any other service (including, for example, the imposition by the CLIENT on the driver of an excessive wait in relation to the dates and times of unloading on the transport document) will be considered as an ancillary service subject to an autonomous remuneration.
The CUSTOMER must ensure the conditions of access and unloading, placing orders that do not conflict with the limitations of the location, such as the restriction of access to heavy vehicles, ramps, stairs or any other type of physical or legal impediment that constitutes a barrier to the delivery of orders. BARBOT does not assume any damage or loss resulting from unloading in unsuitable places, such as unloading on ramps, stairs or any other that constitutes a risk to physical and material integrity.
The pallets that support the products, certified by the Forest Stewardship Council, are the property of BARBOT. With each shipment, the number of pallets sent to the CLIENT is recorded, and the balance between pallets sent by BARBOT and pallets returned by the CLIENT is periodically calculated. The missing part will be invoiced at the unit value of 15 euros. It is thus intended to ensure the circularity of materials, in line with BARBOT’s environmental sustainability policy
For more detailed information on the processing of orders and deliveries, please consult the “Supply Rules”, available on this same Barbot website (Terms & Conditions), in the B2B Supply Rules tab or by requesting Customer Service.
Order Reception
At the time of delivery, the customer must examine the order in order to verify its good condition and compliance with the respective order and the delivery note. To prove the aforementioned compliance, the CLIENT must sign the carrier’s guide.
BARBOT assumes damages resulting from the transport provided that they are communicated in writing, immediately and in the transport document and communicated to BARBOT within a maximum period of 5 working days. Otherwise, BARBOT will consider that the CLIENT has received and accepted the order as delivered.
Warranty
BARBOT guarantees the quality of its products in accordance with the respective technical data sheets. The information presented in the technical sheets is the result of laboratory tests and is merely indicative.
BARBOT’s products are semi-finished products, so the final result depends on factors that are not controllable by Barbot, namely surface preparation, environmental conditions, application conditions, etc. BARBOT’s sales representatives may give non-binding suggestions for the application of the products, which do not imply any type of monitoring or inspection of the work.
BARBOT’s duty of warranty does not exist in cases that result from misapplication, inappropriate or incorrect use of the product, fortuitous or force majeure. Likewise, the warranty expires if there is an unauthorized attempt to repair the product and/or if there is a change in its structure, components or mode of operation. In this case, in addition to the loss of warranty, BARBOT will not be responsible for the incorrect and/or non-conforming use of the product by the CLIENT.
Complaints
Customer “Consumer”
Under the terms of the Law in force, and for commercial and technical assistance purposes, BARBOT will consider the CLIENT as a “Consumer” to whom goods or services intended for non-professional use are supplied.
The “Consumer” CUSTOMER, whenever he believes that there is a lack of conformity of the product, must communicate this situation to BARBOT, in writing and attaching his purchase invoice, within a maximum period of two months from his knowledge. Once this communication has been made, BARBOT will evaluate the specific situation, taking into account all legal obligations and those arising from these conditions of sale, responding to the CUSTOMER accordingly.
Other Clients
Under the terms of the Law in force, BARBOT will only accept complaints of possible non-conformity of its products from CUSTOMERS to whom a document proving the sale of their products by BARBOT has been issued.
Complaints must be placed in writing, in the CLIENT’s own document, with a header and with the contacts of the people involved. Preferably, and whenever possible, the complaint of any lack of conformity of the product can be made by the CUSTOMER at the time of delivery/receipt of the product. When this is not possible, the complaint must be made within 8 days of becoming aware of it, without ever exceeding the legal deadlines for exercising the respective rights. If the CLIENT does not respect these deadlines, his right will expire and he will no longer be able to invoke it in any situation.
Any complaint regarding a BARBOT product will have to be handled by a technical-commercial assistance. The measurement and repair of product non-conformities in accordance with the BARBOT warranty will be carried out by elements of the BARBOT Technical Department.
For the purposes of technical assistance, under the terms of the Law in force, BARBOT will consider as a “Final Consumer” the one to whom products or services intended for non-professional use are supplied.
The final decision regarding any complaint will always belong to BARBOT’s Sales Department. If the decision is negative, a written response will be given to the CLIENT, explaining the reason. If the decision is positive, BARBOT will only accept responsibility for the replacement of the product technically recognized as non-conforming with an equal quantity of the same product or the return of the price already paid for the merchandise known to be defective, not accepting other responsibilities for any other losses or damages.
Returns
Returns are only admissible in the event of a complaint granted by BARBOT, always requiring a prior written agreement, accompanied by a return note issued by the customer on the Tax Authority platform that identifies the product and quantity, as well as the purchase document number.
BARBOT does not accept returns of custom-made products, namely products tuned to the color or identified as being Products on request, duly marked in the Price List as follows:
Industrial Property
BARBOT is the full owner of all intellectual and/or industrial rights of its products, equipment, components and other items sold and/or used in its activity, including commercial, technical or any other documentation. BARBOT will not grant any industrial property rights over any of its products, even when they have been specially developed at the request of a particular CLIENT. Under penalty of civil and/or criminal prosecution, it will be forbidden for any entity or person outside BARBOT to use or reproduce, in whole or in part, trademarks, designs, models, patents, or other elements that are the subject of BARBOT’s intellectual or industrial property. For the purpose of communicating and promoting BARBOT products, customers may only use materials (images, videos, technical sheets, etc.) that have been provided and/or pre-approved by BARBOT.
Processing of Personal Data
The processing of personal data carried out by BARBOT complies with current data protection legislation, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“General Data Protection Regulation”) and other applicable EU and national legislation. General Conditions of Sale for Online Store
The commercial relations between BARBOT – INDÚSTRIA DE TINTAS, S.A. (BARBOT) and any entity that may purchase its products online (CUSTOMERS) will be regulated by these General Conditions of Sale. In any case, these General Conditions of Sale are deemed to have been accepted without reservation by the CUSTOMER.
Preliminary Note
Due to the chromia scale, there may be a color variation of 10% to 20% between the product displayed on the site and the final product. This can, of course, generate a difference between the CLIENT's expectations and reality.
Adjusting your computer settings is therefore key to reducing tone divergence.
The CLIENT expressly agrees that the risk of using the online store – including all content, data or software distributed, downloaded or accessed – is solely at his/her own risk.
Therefore, we inform all CUSTOMERS in advance that paints can only be returned in cases that will be determined in these conditions. In other situations, fine-tuned inks cannot be returned.
Orders
For all due and legal purposes, it should be noted that BARBOT reserves the right not to supply any order that is not validated, whether due to commercial or financial conditions.
The CLIENT, from now on, expressly accepts and acknowledges that:
- The images of the items presented in the online store are merely illustrative and may vary in color under the terms expressed in the PRELIMINARY NOTE, and the CUSTOMER must carefully and fully read the information about the technical characteristics of the items. In case of doubt, the CLIENT can go to any BARBOT physical Store in order to obtain any additional information or details;
- BARBOT will make all reasonable efforts to include accurate and up-to-date information about its products available on the website;
- The prices of the items indicated in the online store correspond to the full amount to be paid by the CUSTOMER, being completely independent of any price fluctuation practiced by BARBOT in its physical stores.
For the purpose of confirming the order through the online store, the CUSTOMER will have to fill out a form in which they must indicate:
- Full name / company name to be included on the invoice;
- NIF / NIPC;
- Address to be shown on the invoice;
- Telephone contacts and e-mail addresses;
The CLIENT guarantees the veracity and accuracy of the data provided when filling out the contracting forms.
The CUSTOMER undertakes to carefully check the data contained in their order summary, confirming the items and services selected in the shopping cart, CUSTOMER data and billing data, and must then go back to the previous steps in order to proceed with the respective rectification if they detect any non-conformity.
The CLIENT must select the payment method.
After completing the previous steps and confirming acceptance of the General Terms & Conditions, the CLIENT will have the possibility to activate the "CONFIRM ORDER" button.
BARBOT will acknowledge receipt of the order by e-mail sent to the e-mail address provided by the CLIENT. Once payment has been confirmed by BARBOT, the respective invoice will be sent upon delivery of the purchased items.
Subsequent amendments to the current General Terms & Conditions are not binding on the CLIENT.
The CLIENT must print a copy of this document on the date of his purchase for future registration.
The processing of personal data carried out by BARBOT complies with current data protection legislation, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("General Data Protection Regulation") and other applicable EU and national legislation.
For more information, please see our Privacy Policy.
Cancellation of the order or resolution of the order
When the purchase process is completed and in the case of fine-tuned paints, the products cannot be modified and the order cannot be cancelled. In order to ensure delivery within short deadlines, orders are immediately processed, preventing any changes.
In other cases, the CLIENT enjoys a minimum period of fourteen days to terminate the contract without the need to indicate the reason. In these cases, the costs of returning the products will be entirely borne by the CUSTOMER. When the right of free withdrawal has been exercised by the CLIENT, BARBOT undertakes to reimburse the same within a maximum period of 30 days in relation to the amounts paid.
It should also be noted that BARBOT reserves the right to cancel an order for a product with a promotion in the event that there is any false or dubious identification element (name, email address, billing address, shipping address, contact, credit card number of the User).
Deliveries
The normal delivery time in mainland Portugal for the products available in the BARBOT online store will be 3 (three) working days. This information on the delivery time is merely indicative, so BARBOT will not accept, under any circumstances, any penalty for missed delivery dates.
On the Islands and taking into account the conditions of transport, the delivery deadlines will be indicated to the CUSTOMER when accepting the order.
The products will be delivered to the location to be defined by the CUSTOMER.
The products must be checked by the CUSTOMERS upon delivery.
Any claims relating to the delivery or carriage of goods must be put in writing and immediately on the proper transport document.
Orders with a value of less than €50.00 will be charged to the CUSTOMER of €10.00 to support the additional costs of transport and processing.
Prices
The final price of the product will be the price shown on the date and time of the order.
The prices shown in the online store may be changed at any time, without prior notice.
Payment
Payments can be made by ATM, MB Way, PayPal, Credit Card or Debit Card and will be transferred on the date of the order.
The CLIENT ensures that all details provided at the time of ordering are correct and valid.
The CUSTOMER also ensures that the credit/debit card has sufficient funds to cover the costs of the order.
BARBOT reserves the right to obtain validation of the CLIENT's credit/debit card before processing any order. In this way, the contract will only be fully concluded when the amounts due have been received and confirmed by BARBOT.
BARBOT ensures that the entire payment process is done with total security.
Warranty
BARBOT guarantees the conformity of its products in accordance with the technical specifications contained in the respective technical data sheets.
The duty of guarantee does not exist in cases that result from misapplication, inappropriate or incorrect use of the product, fortuitous or force majeure. Likewise, the warranty expires if there is an unauthorized attempt to repair the product and/or in which there is a change in its structure, components or mode of operation.
There will be no non-conformity of the product in the fine-tuned inks, under the terms of the preliminary note and when the product:
- conforms to the description given to it and possesses the qualities that BARBOT has presented as a sample or model;
- it is suitable for the specific use for which the CLIENT is intended and of which BARBOT has informed BARBOT at the time of entering into the contract and the latter has accepted;
- it is suitable for the usual uses of goods of the same type;
- present the qualities and performance usual in products of the same type and that the CUSTOMER can reasonably expect, given the nature of the product and, if necessary, the public statements about its specific characteristics made by BARVOT (namely in advertising or labelling);
Complaints
BARBOT undertakes to reproduce the CLIENT's order in full, safeguarding itself from slight variations in colour (in accordance with the previous note) or any other errors for which the CLIENT is responsible.
We remind you that BARBOT's products are semi-finished products, the final result of which depends on uncontrollable factors (namely, surface preparation, environmental conditions, application conditions, etc.).
BARBOT's commercial services may give non-binding suggestions for the application of the products. These suggestions do not imply any type of monitoring or inspection of the work.
Under the terms of the Law in force, the CLIENT, whenever the CLIENT understands that there is a lack of conformity of the product, must report this situation to BARBOT, in writing and attaching its purchase invoice, within a maximum period of two months from its knowledge. This denunciation, however, cannot occur beyond two years from the date of purchase on the invoice.
If the CLIENT does not respect these deadlines, his right will expire and he will no longer be able to invoke it in any situation.
The final decision on any claim will always belong to the BARBOT Sales Department. If the decision is negative, a written response will be given to the CLIENT, explaining the reason. If the decision is positive, BARBOT will only accept responsibility for the replacement of a product technically recognized as non-conforming by an equal quantity of the same product.
Although BARBOT strives to ensure total CUSTOMER satisfaction, in situations where the order is non-compliant, it undertakes to:
- replace the product in the shortest possible time and at no cost to the CUSTOMER; or
- return the monetary amount paid by the CUSTOMER for the order. The amount in question (total amount spent on the product including shipping costs) will be refunded within a maximum period of 30 days after the final decision of the Sales Department;
Technical Support
Any complaint regarding a BARBOT product will have to be handled by a technical assistance.
The assessment and repair of product non-conformities in accordance with the BARBOT warranty will be carried out by members of the BARBOT Technical Department.
BARBOT's technical support services are available to CUSTOMERS for the application and maintenance of BARBOT products, upon payment of their cost.
For the purposes of technical assistance, the CLIENT must, whenever it deems it necessary professional technical assistance due to a possible lack of conformity of the product, report this situation to BARBOT in writing, within a maximum period of two months from its knowledge. This denunciation, however, cannot occur beyond two years from the date of purchase on the invoice.
Under penalty of civil and/or criminal prosecution, it will be forbidden for any entity or person outside BARBOT to use or reproduce, in whole or in part, trademarks, designs, models, patents, or other elements that are the subject of BARBOT's intellectual or industrial property.
Jurisdiction and Jurisdiction

BARBOT does not accept returns of custom-made products, namely products tuned to the color or identified in the Price List, as products available on request.
Pallets
The white pallets that support the products, certified by the Forest Stewardship Council, are owned by BARBOT. The blue pallets that support the products are the property of CHEP.
Monthly the balance between pallets sent and collected will be communicated to the CUSTOMER. At the end of each year, the final calculation will be made, and the pallets not returned will be invoiced at the unit value of €15 per pallet.
This practice aims to ensure the circularity of materials, in line with BARBOT’s environmental sustainability policy.
The collection of pallets is managed by BARBOT, and the CUSTOMER must return pallets only to drivers who present valid documentation.
Supply at Barbot Stores
The Barbot store network is sized to serve the retail customer, that is, the private or professional customer, who purchases the product for application or incorporation, and for this reason they are not prepared for the particularities of the requests of reseller customers.
